It is often a challenge to protect survivors’ privacy in any environment, but it can be especially difficult for survivors of campus sexual assault and those who serve them. Student survivors’ privacy is governed by a variety of state and federal laws as well as campus policies. For survivors who seek a SANE exam, medical privacy laws create yet another layer of complexity. Healthcare providers should recognize the privacy issues and know what privacy provisions impact the care they provide to the patient both at the time of the exam and in any criminal, civil, administrative, and campus hearings that may follow. In this webinar, the Victim Rights Law Center’s Jessie Mindlin and International Association of Forensic Nurses’ Kim Day will discuss common privacy issues for campus survivors and the potential impact this can have when care is delivered in different settings. At the end of this webinar we expect participants will be able to: Outline care-related privacy issues a survivor of campus sexual assault may confront post-assault; Describe a sexual assault examiner’s privacy obligations when providing care to student survivors; Identify and anticipate medical forensic exam-related privacy considerations for the student survivor and the sexual assault examiner who provides their assault-related care.
